Purpose and Scope of Application<\/strong><\/h3><p class=\"wp-block-paragraph\">This document governs the terms and conditions relating to the<strong> right of withdrawal<\/strong>, returns, and<strong> refunds<\/strong> for<strong> rental<\/strong> and <strong>purchase<\/strong> contracts of garments, accessories, and made-to-measure items concluded online through the website www.ilmiosmoking.com (hereinafter the \u201cWebsite\u201d), operated by<strong> Il Mio Smoking<\/strong>, VAT no.<strong> 03286450212<\/strong>, e-mail: info@ilmiosmoking.com (hereinafter the \u201cSupplier\u201d).<\/p><p class=\"wp-block-paragraph\">Contracts concluded through the Website are<strong> distance contracts<\/strong> pursuant to Articles 45 et seq. of <strong>Legislative Decree 206\/2005 206\/2005<\/strong> (\u201cConsumer Code\u201d).<\/p><hr class=\"wp-block-separator has-alpha-channel-opacity\"\/><h3 class=\"wp-block-heading\"><strong>2. Types of Products and Services Offered<\/strong><\/h3><p class=\"wp-block-paragraph\">The Supplier offers the following categories:<\/p><ul class=\"wp-block-list\"><li><strong>Standard Rental:<\/strong> garments available in the catalogue, not customized.<br\/><\/li>\n\n<li><strong>Made-to-Measure\/Customized Rental:<\/strong> garments adapted or modified according to the customer\u2019s measurements or requests.<\/li>\n\n<li><strong>Acquisto standard<\/strong>: abiti o accessori nuovi o ex-noleggio, non personalizzati.<\/li>\n\n<li><strong>Standard Purchase:<\/strong> new or ex-rental garments or accessories, not customized.<br\/><\/li><\/ul><hr class=\"wp-block-separator has-alpha-channel-opacity\"\/><h3 class=\"wp-block-heading\"><strong>3. Right of Withdrawal<\/strong><\/h3><p class=\"wp-block-paragraph\">The right of withdrawal referred to in Article 52 of the Consumer Code applies <strong>only to purchase contracts for goods<\/strong> and not to rental contracts. <\/p><ul class=\"wp-block-list\"><li>For<strong> purchased goods <\/strong>(both standard and customized, within the limits set by law), the consumer has the right to withdraw from the contract within 14 days without providing any reason, except for the exclusions provided by law.<\/li>\n\n<li>For rented goods, the right of withdrawal is <strong>excluded.<\/strong><\/li><\/ul><p class=\"wp-block-paragraph\">In any case, the Customer is invited to read the specific conditions related to each type of service (rental or purchase) outlined in the following paragraphs.<\/p><hr class=\"wp-block-separator has-alpha-channel-opacity\"\/><h3 class=\"wp-block-heading\"><strong>4. Exceptions to the Right of Withdrawal<\/strong><\/h3><p class=\"wp-block-paragraph\">In accordance with Article 59 of the Consumer Code, the<strong> right of withdrawal<\/strong> does not apply in the following cases: <\/p><ol class=\"wp-block-list\"><li><strong>Goods made to measure or clearly personalized<\/strong> (Art. 59, letter c));<\/li>\n\n<li><strong>Services already fully performed<\/strong>, if the performance has begun with the express consent of the customer and with their acknowledgment of the loss of the right of withdrawal (Art. 59, letter a));<\/li>\n\n<li>Goods or services whose price depends on market fluctuations beyond the Supplier\u2019s control;<\/li>\n\n<li>Goods returned incomplete, used, washed, or without original tags and packaging.<\/li><\/ol><hr class=\"wp-block-separator has-alpha-channel-opacity\"\/><h3 class=\"wp-block-heading\"><strong>5. Rental<\/strong><\/h3><h3 class=\"wp-block-heading\"><strong><strong>5.1 Exclusion of the Right of Withdrawal (Art. 59, letter n) Consumer Code)<\/strong><\/strong><br\/><br\/><\/h3><h3 class=\"wp-block-heading\"><strong>Standard Rental, Made-to-Measure or Customized Rental<\/strong><\/h3><p class=\"wp-block-paragraph\"><strong>The right of withdrawal is excluded, as these are supplies of goods made or adapted to the customer\u2019s specifications (Art. 59, letter c) Consumer Code).<\/strong><\/p><p class=\"wp-block-paragraph\"><strong>IMPORTANT:<\/strong> Pursuant to <strong>Article 59<\/strong>, <strong>paragraph 1, letter n<\/strong>) of the Consumer Code, the right of withdrawal is EXCLUDED for contracts relating to<strong> leisure activities<\/strong> if the contract provides for a <strong>specific date or period of performance. Customers are expressly informed that the rental of a garment or accessory through this Website falls within this exception.<\/strong><\/p><p class=\"wp-block-paragraph\">Our rental service constitutes the <strong>exclusive allocation of a physical item<\/strong> (the garment or accessories) for a <strong>specific, non-modifiable period<\/strong>, as indicated by the Customer during booking.<br\/>Therefore, once the reservation for a specific date has been confirmed and the garment <strong>removed from inventory availability<\/strong> for that period, the <strong>Customer may not exercise the right of withdrawal<\/strong> pursuant to Articles 52 et seq. of the Consumer Code. <\/p><p class=\"wp-block-paragraph\">The Customer must therefore carefully verify the accuracy of the selected date before proceeding with payment.<br\/>Consequences in Case of Customer Error in Date Selection<br\/>If the Customer makes an error in selecting the date and can no longer use the rental for the confirmed date:<\/p><ul class=\"wp-block-list\"><li>The Company may, at its sole discretion and as a commercial courtesy, offer alternatives such as a credit for future rental or a date change, depending on garment availability and current business policies.<\/li><\/ul><h3 class=\"wp-block-heading\">5.2 Return of the Garment at the End of the Rental Period<\/h3><p class=\"wp-block-paragraph\">This section exclusively governs the procedures for returning the garment at the end of the agreed rental period and does not concern the exercise of the right of withdrawal.<\/p><p class=\"wp-block-paragraph\">The return of the garment is an integral part of the rental service and must take place at the end of the agreed period.<\/p><p class=\"wp-block-paragraph\">The garment must be returned within the timeframe and according to the methods indicated at the time of order (for example, via home pickup or shipment using the designated courier).<\/p><p class=\"wp-block-paragraph\">In case of late return or damage to the garment, penalties or charges may be applied in accordance with the General Rental Terms and Conditions.<\/p><p class=\"wp-block-paragraph\">Failure to comply with the return procedures may result in the charge of the garment\u2019s replacement value.<\/p><hr class=\"wp-block-separator has-alpha-channel-opacity\"\/><h3 class=\"wp-block-heading\"><strong>6. Purchase<\/strong><\/h3><h3 class=\"wp-block-heading\"><strong>6.1 Standard Purchase (Non-Customized)<\/strong><\/h3><p class=\"wp-block-paragraph\">The customer may exercise the right of withdrawal within<strong> 14 days from delivery of the item<\/strong>, provided that the product:<\/p><ul class=\"wp-block-list\"><li>has not been used, washed, or damaged;<\/li>\n\n<li>is returned complete with original labels, packaging, and accessories.<\/li><\/ul><p class=\"wp-block-paragraph\">Return shipping costs are borne by the customer, unless otherwise agreed in the contract.<\/p><h3 class=\"wp-block-heading\"><strong>6.2 Made-to-Measure or Customized Purchase<\/strong><\/h3><p class=\"wp-block-paragraph\">The right of withdrawal is<strong> excluded <\/strong>for garments made or modified to measure according to the customer\u2019s requests (Art. 59, letter c) of the Consumer Code).<\/p><hr class=\"wp-block-separator has-alpha-channel-opacity\"\/><h3 class=\"wp-block-heading\"><strong>7. How to Exercise the Right of Withdrawal<\/strong><\/h3><p class=\"wp-block-paragraph\">Where applicable, the customer may exercise the right of withdrawal within<strong> 14 days<\/strong> by sending written notice to:<\/p><p class=\"wp-block-paragraph\">info@ilmiosmoking.com<br\/>\ud83d\udcde<strong> +39 349 5915838<\/strong><\/p><p class=\"wp-block-paragraph\">The communication must include:<\/p><ul class=\"wp-block-list\"><li>customer\u2019s full name and contact details;<\/li>\n\n<li>order number and date;<\/li>\n\n<li>clear statement of the intention to withdraw;<\/li>\n\n<li>for products, a declaration that the goods have not been used or damaged.<\/li><\/ul><h4 class=\"wp-block-heading\"><strong>Sample Withdrawal Form (Optional)<\/strong><\/h4><p class=\"wp-block-paragraph\">(pursuant to Article 49, paragraph 1, letter h) of the Consumer Code)<\/p><blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p class=\"wp-block-paragraph\"><strong>Recipient: <\/strong>Il Mio Smoking S.r.l., [full address], e-mail: <strong>info@ilmiosmoking.com<\/strong><br\/>I\/we () hereby give notice of withdrawal from the sales or rental contract for the following goods\/services:<br\/>Ordered on () \/ received on ():<br\/>Name of consumer(s):<br\/>Address of consumer(s):<br\/>Signature of consumer(s) (only if submitted on paper):<br\/>Date:<br\/>() Delete as appropriate.<\/p><\/blockquote><hr class=\"wp-block-separator has-alpha-channel-opacity\"\/><h3 class=\"wp-block-heading\"><strong>8. Return of Goods<\/strong><\/h3><p class=\"wp-block-paragraph\">The customer must return the item within<strong> 14 days<\/strong> of notifying withdrawal, unless otherwise instructed by the Supplier.<br\/>The product must be returned <strong>intact, clean, unused<\/strong>, complete with tags, packaging, and accessories.<\/p><p class=\"wp-block-paragraph\">The Supplier may refuse the return or reduce the refund in the event of:<\/p><ul class=\"wp-block-list\"><li>improper use of the item;<\/li>\n\n<li>missing accessories or packaging;<\/li>\n\n<li>damage due to negligence.<\/li><\/ul><hr class=\"wp-block-separator has-alpha-channel-opacity\"\/><h3 class=\"wp-block-heading\"><strong>9. Refund<\/strong><\/h3><p class=\"wp-block-paragraph\">Il Mio Smoking will refund all payments received within 14 days of receiving the returned goods.<br\/>Return shipping costs remain the responsibility of the customer.<\/p><hr class=\"wp-block-separator has-alpha-channel-opacity\"\/><h3 class=\"wp-block-heading\"><strong>10. Defective or Non-Conforming Products<\/strong><\/h3><p class=\"wp-block-paragraph\">In case of defective, damaged, or non-conforming products, the customer must contact customer service within <strong>24 hours of delivery,<\/strong> attaching photographic evidence if available.<\/p><ul class=\"wp-block-list\"><li>replace the item free of charge;<\/li>\n\n<li>offer a partial refund;<\/li>\n\n<li>provide a full refund in cases where replacement is not possible.<\/li><\/ul><hr class=\"wp-block-separator has-alpha-channel-opacity\"\/><h3 class=\"wp-block-heading\"><strong>11.
