Purpose and Scope<\/h2><p data-start=\"158\" data-end=\"536\">This document governs the conditions regarding the right of withdrawal, returns, and refunds for rental and purchase contracts of clothing, accessories, and made-to-measure items concluded online via the website <a class=\"decorated-link cursor-pointer\" target=\"_new\" rel=\"noopener\" data-start=\"370\" data-end=\"390\">www.ilmiosmoking.com<\/a> (hereinafter the \u201cWebsite\u201d), operated by <strong data-start=\"432\" data-end=\"450\">Il Mio Smoking<\/strong>, VAT number 03286450212, email: <a class=\"decorated-link cursor-pointer\" rel=\"noopener\" data-start=\"483\" data-end=\"504\">info@ilmiosmoking.com<\/a> (hereinafter the \u201cProvider\u201d).<\/p><p data-start=\"538\" data-end=\"694\">Contracts concluded through the Website are distance contracts pursuant to Articles 45 and following of Legislative Decree No. 206\/2005 (\u201cConsumer Code\u201d).<\/p><h2 data-start=\"696\" data-end=\"740\">2. Types of Products and Services Offered<\/h2><p data-start=\"741\" data-end=\"788\">The Provider offers the following categories:<\/p><ul data-start=\"790\" data-end=\"1199\"><li data-start=\"790\" data-end=\"865\"><p data-start=\"792\" data-end=\"865\"><strong data-start=\"792\" data-end=\"812\">Standard Rental:<\/strong> garments available in the catalog, not customized.<\/p><\/li><li data-start=\"866\" data-end=\"993\"><p data-start=\"868\" data-end=\"993\"><strong data-start=\"868\" data-end=\"908\">Made-to-Measure \/ Customized Rental:<\/strong> garments adapted or modified according to the customer\u2019s measurements or requests.<\/p><\/li><li data-start=\"994\" data-end=\"1078\"><p data-start=\"996\" data-end=\"1078\"><strong data-start=\"996\" data-end=\"1018\">Standard Purchase:<\/strong> new or ex-rental garments or accessories, not customized.<\/p><\/li><li data-start=\"1079\" data-end=\"1199\"><p data-start=\"1081\" data-end=\"1199\"><strong data-start=\"1081\" data-end=\"1123\">Made-to-Measure \/ Customized Purchase:<\/strong> garments tailored or modified according to the customer\u2019s specifications.<\/p><\/li><\/ul><h2 data-start=\"1201\" data-end=\"1226\">3. Right of Withdrawal<\/h2><p data-start=\"1227\" data-end=\"1371\">The right of withdrawal under Article 52 of the Consumer Code applies exclusively to purchase contracts for goods and not to rental contracts.<\/p><ul data-start=\"1373\" data-end=\"1662\"><li data-start=\"1373\" data-end=\"1603\"><p data-start=\"1375\" data-end=\"1603\">For purchased goods (both standard and made-to-measure, within the limits provided by law), the consumer has the right to withdraw from the contract within 14 days without providing any reason, subject to statutory exclusions.<\/p><\/li><li data-start=\"1604\" data-end=\"1662\"><p data-start=\"1606\" data-end=\"1662\">For rented goods, the right of withdrawal is excluded.<\/p><\/li><\/ul><p data-start=\"1664\" data-end=\"1832\">In any case, the Customer is advised to review the specific conditions applicable to each type of service (rental or purchase), as outlined in the following sections.<\/p><h2 data-start=\"1834\" data-end=\"1877\">4. Exceptions to the Right of Withdrawal<\/h2><p data-start=\"1878\" data-end=\"1994\">In accordance with Article 59 of the Consumer Code, the right of withdrawal does not apply in the following cases:<\/p><ul data-start=\"1996\" data-end=\"2431\"><li data-start=\"1996\" data-end=\"2065\"><p data-start=\"1998\" data-end=\"2065\">Goods made-to-measure or clearly customized (Art. 59, letter c));<\/p><\/li><li data-start=\"2066\" data-end=\"2241\"><p data-start=\"2068\" data-end=\"2241\">Services already fully performed, if performance began with the express consent of the customer and acceptance of the loss of the right of withdrawal (Art. 59, letter a));<\/p><\/li><li data-start=\"2242\" data-end=\"2344\"><p data-start=\"2244\" data-end=\"2344\">Goods or services whose price depends on fluctuations in the market beyond the Provider\u2019s control;<\/p><\/li><li data-start=\"2345\" data-end=\"2431\"><p data-start=\"2347\" data-end=\"2431\">Goods returned not intact, used, washed, or missing original labels and packaging.<\/p><\/li><\/ul><h2 data-start=\"2433\" data-end=\"2445\">5. Rental<\/h2><h3 data-start=\"2447\" data-end=\"2526\">5.1 Exclusion of the Right of Withdrawal (Art. 59, letter n) Consumer Code)<\/h3><p data-start=\"2527\" data-end=\"2585\"><strong data-start=\"2527\" data-end=\"2583\">Standard Rental, Made-to-Measure \/ Customized Rental<\/strong><\/p><p data-start=\"2587\" data-end=\"2747\">The right of withdrawal is excluded, as this involves the supply of goods made or adapted to the customer\u2019s specifications (Art. 59, letter c) Consumer Code).<\/p><p data-start=\"2749\" data-end=\"2995\"><strong data-start=\"2749\" data-end=\"2761\">WARNING:<\/strong> Pursuant to Article 59, paragraph 1, letter n) of the Consumer Code, the right of withdrawal is EXCLUDED for contracts for services related to leisure activities when the contract specifies a specific date or period of performance.<\/p><p data-start=\"2997\" data-end=\"3111\">Customers are expressly informed that renting a garment or accessory on this Website falls under this exception.<\/p><p data-start=\"3113\" data-end=\"3317\">Our rental service consists of the exclusive allocation of a physical item (the garment or various accessories) for a specific and non-modifiable period indicated by the Customer at the time of booking.<\/p><p data-start=\"3319\" data-end=\"3577\">Consequently, once the booking for a specific date is confirmed and the corresponding garment is removed from inventory availability for that period, the Customer cannot exercise the right of withdrawal under Articles 52 and following of the Consumer Code.<\/p><p data-start=\"3579\" data-end=\"3739\"><strong data-start=\"3579\" data-end=\"3631\">Customer Responsibility Regarding Date Selection<\/strong><br data-start=\"3631\" data-end=\"3634\" \/>The Customer must carefully verify the correctness of the selected date before proceeding with payment.<\/p><p data-start=\"3741\" data-end=\"3895\"><strong data-start=\"3741\" data-end=\"3795\">Consequences in Case of Customer Error on the Date<\/strong><br data-start=\"3795\" data-end=\"3798\" \/>If the Customer selects the wrong date and can no longer use the rental for the confirmed date:<\/p><ul data-start=\"3897\" data-end=\"4163\"><li data-start=\"3897\" data-end=\"4163\"><p data-start=\"3899\" data-end=\"4163\">The Company may, at its sole discretion and as a commercial courtesy, offer alternatives such as credit for a future rental or the possibility of changing the date, subject to garment availability and the commercial policies in effect at the time of the request.<\/p><\/li><\/ul><h3 data-start=\"4165\" data-end=\"4219\">5.2 Return of the Garment at the End of the Rental<\/h3><p data-start=\"4220\" data-end=\"4395\">This section exclusively governs the procedure for returning the garment at the end of the agreed rental period and does not concern the exercise of the right of withdrawal.<\/p><p data-start=\"4397\" data-end=\"4514\">The return of the garment is an integral part of the rental service and must occur at the end of the agreed period.<\/p><p data-start=\"4516\" data-end=\"4683\">The garment must be returned within the terms and according to the methods indicated at the time of order (e.g., home pick-up or shipment via an authorized courier).<\/p><p data-start=\"4685\" data-end=\"4816\">In case of late return or damage to the garment, penalties or charges may apply in accordance with the General Rental Conditions.<\/p><p data-start=\"4818\" data-end=\"4931\">Failure to comply with the return procedures may result in a charge equal to the replacement value of the item.<\/p><h2 data-start=\"4933\" data-end=\"4947\">6. Purchase<\/h2><h3 data-start=\"4949\" data-end=\"4991\">6.1 Standard Purchase (Non-Customized)<\/h3><p data-start=\"4992\" data-end=\"5112\">The customer may exercise the right of withdrawal within 14 days from receipt of the goods, provided that the product:<\/p><ul data-start=\"5114\" data-end=\"5231\"><li data-start=\"5114\" data-end=\"5156\"><p data-start=\"5116\" data-end=\"5156\">Has not been used, washed, or damaged;<\/p><\/li><li data-start=\"5157\" data-end=\"5231\"><p data-start=\"5159\" data-end=\"5231\">Is returned complete with original labels, packaging, and accessories.<\/p><\/li><\/ul><p data-start=\"5233\" data-end=\"5340\">Return shipping costs are the responsibility of the customer, unless otherwise specified in the contract.<\/p><h3 data-start=\"5342\" data-end=\"5387\">6.2 Made-to-Measure \/ Customized Purchase<\/h3><p data-start=\"5388\" data-end=\"5531\">The right of withdrawal is excluded for garments made or modified to the customer\u2019s specifications (Art. 59, letter c) of the Consumer Code).<\/p><h2 data-start=\"5533\" data-end=\"5578\">7.
